While many of these restrictions are reasonable, the final restriction mentioned - the prohibition on electronic cigarette companies claiming that these products are safer than tobacco cigarettes - is both inappropriate and devastating to the public health interest.

For all three grades combined, the percentage of students who reported smoking cigarettes in the past month fell from 10.6 percent in 2012 to 9.6 percent in 2013. Smoking declined from 17.1 to 16.3 percent among 12th graders, from 10.8 to 9.1 percent among 10th graders and from 4.9 to 4.5 percent among 8th graders. The declines were statistically significantly for 10th graders and for all three grades combined."

Why is it negligent? Because it deviates from a well-accepted standard of care in medical and respiratory therapy practice, which is telling the truth. By disseminating false information - that smoking may be no more hazardous than vaping - to patients, this could lead to medical harm by convincing smokers not to quit via electronic cigarettes, but based on false information.

There does need to be some restriction on the marketing of electronic cigarettes to youth. The FDA deferred a decision on marketing restrictions at this time. However, it is important that the agency does revisit this issue and that it craft restrictions that carefully balance the desire to protect youth from this advertising with the need for e-cigarette companies to be able to reach adult consumers.
