And it is not the CEOs of Blu or NJOY who shouldn't be able to sleep at night, it is Senator Rockefeller. How can he sleep each night, knowing that his actions are responsible for thousands of kids who, in the past four years, have become addicted to menthol cigarettes because he failed to act responsibly and are eventually going to die prematurely because of his sellout to Philip Morris?

Senator Boxer also has no business excoriating the e-cigarette executives as she, too, sold out to Big Tobacco by supporting the legislation which exempted menthol from the cigarette flavoring ban. And she, too, has failed to sponsor legislation - now or any time in the past four years - that would correct the problem now by banning menthol cigarettes.

For several years, the Rest of the Story has been arguing against policies by which employers refuse to hire smokers. My main argument is that this is a form of employment discrimination and is therefore unwarranted. Further, I have suggested that refusing to hire smokers opens the door to discriminating against other groups, such as obese persons.

Many anti-smoking groups and advocates have been pushing for a ban on the use of flavorings in electronic cigarettes. Such a ban would have devastated the industry, as the flavors are a key aspect of what makes these products competitive with tobacco cigarettes. In addition, the flavors make e-cigarettes distinct from tobacco cigarettes and make it much less likely that people who switch to these products will return to regular cigarettes. In addition, youth who use flavored electronic cigarettes are most likely less inclined to initiate smoking because once they are accustomed to the flavors, cigarettes would seem extremely harsh.

Moreover, these politicians - while callling for a ban on flavorings in fake cigarettes - are not calling for a similar ban on all flavorings in real cigarettes. They are not calling for a ban on the use of menthol cigarettes to addict kids. They are not calling on legislation to amend the Family Smoking Prevention and Tobacco Control Act to remove the menthol exemption. They are not calling upon the FDA to ban menthol.
