As I found out when I simply proposed the rather benign, but crucial to science, idea of conducting a clinical trial to examine the effects of electronic cigarettes on smoking behavior (in comparison to the nicotine patch, a well-accepted standard), there is very little room for balanced, objective thinking in the current tobacco control/harm reduction environment. The simple proposal to conduct such a crucial study brought out personal attacks and profound criticism. This despite the fact that every single electronic cigarette company representative I talked to about the proposal felt that the study was critical and needs to be conducted. There was no opposition to conducting sound science among the electronic cigarette companies. All the opposition came from the harm reduction "community."

The rest of the story is that what these members of Congress are asking the Attorneys General to do is to trample on the Constitution. They are asking the Attorneys General to violate the established laws of their state by not only ignoring the clear language of the MSA, but by illegally enforcing a contract on parties that did not consent to that contract in the first place.

• The truth is that there is abundant evidence that electronic cigarettes are much safer than regular cigarettes. Even the tobacco industry itself acknowledges that smoking is more hazardous than vaping.

Another anti-smoking group, responding via email, told me that: "This is precisely how the tobacco industry has influenced the reporting of science. By funding research at universities and engaging professors and researchers as consultants, the industry introduced a bias that influenced these scientist's conduct and reporting of their subsequent research. While the financial relationships may have ended in the light of the public's disdain for the tobacco industry and the public revelations that came out of the DOJ lawsuit, these biases do not just disappear overnight. It is irresponsible and unethical for these researchers to hide their past financial relationships with Big Tobacco, even if the money changed hands more than 36 months ago."
