The Northampton Board of Health may not have created public health regulations that have any consistency or science base. However, they have created an excellent entry for the 2014 Hypocrisy of the Year Award.

The core ethical principle of transparency was spelled out in a Tobacco Control (see Fox BJ. Framing tobacco control efforts within an ethical context. Tobacco Control 2005;14[Suppl II]:ii38-ii44).

The Campaign for Tobacco-Free Kids argued that the tobacco companies and retailers not be allowed to tell consumers that the renamed products are the same as the former products. But this would have been an unconstitutional restriction of free speech. Unless the renamed product is banned, or the descriptor used is in violation of the law because it directly infers that the cigarette is safer, then I'm afraid that the companies are in compliance with the law and the anti-smoking groups are going to have to respect that.

The rest of the story is that these tobacco researchers are apparently lying to the public about the legitimate conclusions of their own study in order to mislead the media and the public about the role of e-cigarettes in youth smoking. This is scientific dishonesty. And regardless of one's position on electronic cigarettes, behavior like this should play no role in the scientific debate over the appropriate role for these products.
