The FDA's Center for Tobacco Products (CTP) assures us that for defective cigarettes, such as those which taste wrong, "issues will be addressed to ensure the protection of the public health." However, for normal cigarettes that are merely toxic or deadly, the FDA has taken no action to date to require these products to be safer.

Ironically, banning the flavors in electronic cigarettes could have the perverse effect of decreasing e-cigarette use but increasing use of real tobacco cigarettes. Hopefully, the FDA will examine this issue closely before taking the advice of anti-smoking groups and advocates, who are already calling for a ban on e-cigarette flavorings.

Now some establishments (especially bars) have weighed in and allowed vaping indoors. I personally always ask the bartender or the manager on duty whether it is okay or not. It is a privilege to be able to vape indoors and like most privileges it can be taken away if it is abused. I’m talking to the high powered personal vaporizer users (myself included) out there!!! Leave your fog machine at home and instead bring your mod (or ) that gets the job done but doesn’t turn your local watering hole into a rave at anightclub.

As a public health advocate, the position of the Tobacco Control Legal Consortium is perplexing to me. The Consortium appears to be calling for the removal of the 24-month grace period for submission of substantial equivalence or new product applications by electronic cigarette products. If this advice were to be implemented, then the only electronic cigarettes that could remain on the market are those which were actually marketed as of February 15, 2007. This means that 99.9% of the electronic cigarettes currently on the market would have to be taken off the market.
