Because products are substantially equivalent only if they pose no different issues of public health, and because flavorings can affect product efficacy and safety, it is probable that every different flavor of every different brand must submit a separate application. Thus, at a minimum, there are going to be at least 466 x 49 applications, or 22,834 required applications.

This is worth repeating: the nation's federal regulatory agency with jurisdiction over cigarettes is not sure that smoking - which kills more than 400,000 Americans each year - is any more dangerous than vaping, which involves no tobacco and no combustion and has not been shown to cause any harm. The FDA is not convinced that inhaling nicotine plus tens of thousands of chemicals and more than 60 known human carcinogens is any worse than inhaling nicotine plus propylene glycol and low levels of a few other chemicals.

All three of these entities have offered common sense advice with which I wholeheartedly agree. In fact, this advice may be the single most important change that I recommend in the proposed deeming regulations.

It may take a Freedom of Interest Act (FOIA) request to obtain this information from OSH, or wherever this "secret" information resides, which is quite a shame given the fact that one of the major points made in the Surgeon General's report is its criticism of the unethical behavior of tobacco industry scientists who hid their financial relationships with the industry. It's sad that the federal government is condemning the past actions of scientists who hid financial connections with Big Tobacco, while it is engaging in the present action of hiding financial connections with Big Pharma.
