I understand the venom that these policy makers have for electronic cigarettes because they look like cigarettes; however, their desire to protect tobacco cigarettes from competition from these safer products is not enough to justify urging their state Attorneys General to trample on the Constitution and to violate well-established state contract law.

In an NPR , CDC director Dr. Thomas Frieden claimed that scientific evidence demonstrates that large numbers of ex-smokers are returning to the use of nicotine products by taking up vaping. He also claimed that electronic cigarettes are deterring smokers from quitting.

There is no question that the best advice to smokers is to quit completely. But for those who are unable to do so, the use of electronic cigarettes to try to quit is sound advice. Clearly, if they quit completely with electronic cigarettes, they have accomplished a huge task in terms of improving their health. But even if they are still dual using, they may have substantially improved their health. And, they may have made it easier to quit completely at a later time.

The ironic thing is that no one actually disagreed with me on the science. Most of the advocates of smokeless tobacco acknowledged that there is a small, but real, causal relationship between traditional smokeless tobacco use and oral cancer (this relationship does not appear to hold for snus). However, simply because I made the statement that this causal link exists, I was blasted. Apparently, the simple statement that smokeless tobacco causes oral cancer is too much for many harm reduction advocates to tolerate.
